In the 20 years of the development of the furniture industry in Beijing, the state and industry have introduced a number of policies and regulations and industry standards related to furniture products, which have had a certain impact on the industry more or less. Today, we have selected six policies and standards from sales, environmental protection, and service. Their existence has better protected consumers' rights and interests, and has made the industry more healthy and more dynamic.
Service: Do not implement three bags of furniture
On September 16, 1998, the Beijing Municipal Bureau of Technical Supervision, the Beijing Municipal Administration of Industry and Commerce, and the Beijing Municipal Commission of Commerce jointly formulated the “Responsibility Regulations for the Repair, Replacement, and Return of Furniture Products in Beijingâ€. According to the regulations, the three-pack period of wooden furniture, metal furniture, spring soft mattress and sofa is one year. The principle of who sells furniture and who is responsible for the three-package is not allowed to sell furniture products.
During the validity period of the three guarantees, the consumer shall go through the formalities of repair, replacement and return with valid documents. If the quality of furniture products causes losses to consumers, sellers and producers shall compensate according to the relevant laws and regulations.
Comments: "Beijing Furniture Product Repair, Replacement, Return Responsibility Regulations" clarifies the responsibility and obligation of the seller and the producer to bear the three guarantees of furniture products, and provides an effective basis for protecting the legitimate rights and interests of consumers.
Intellectual property: furniture design is protected
On October 24, 2000, the industry standard “Trial Measures for the Protection of Furniture Design†formulated and announced by the China Furniture Association came into effect. The "Measures" stipulate that the furniture design patent granted by the State Intellectual Property Office, the furniture design right granted in accordance with the agreement signed by China with foreign countries or the international treaty on intellectual property rights jointly participated shall be protected.
According to the "Measures", after the utility model patent is granted, no unit or individual may manufacture, use or sell its patented products for the purpose of production or business, or use a patented product without the permission of the patentee, except as otherwise stipulated by law. Or use a patented method and use and sell products directly obtained in accordance with the patented method. After the design patent right is granted, no unit or individual may manufacture, use or sell its design patented product for the purpose of production or business operation without the permission of the patentee.
Comment: Although this standard has a certain role in encouraging furniture design innovation and promoting healthy competition in the furniture industry. However, since the standard is only an industry standard and the process of judging patent infringement is complicated, it is difficult to protect the furniture design.
Environmental protection: the minimum amount of harmful materials in furniture
On January 1, 2002, the 10 national compulsory standards jointly formulated by the General Administration of Quality Supervision, Inspection and Quarantine and the National Standardization Administration Committee—the “Limit Standard for Hazardous Substances in Interior Decoration Materials†began to be implemented. The harmful substances of ten interior decoration materials such as wooden furniture were subjected to a minimum amount, and products that did not meet the requirements of the standard were judged to be unqualified products.
Among them, "Limits of Hazardous Substances in Wood Furniture for Interior Decoration Materials" stipulates the limit indicators of harmful elements such as formaldehyde and soluble lead, cadmium, chromium, mercury and arsenic in wood furniture.
Comments: The implementation of "Limited Quantity of Hazardous Materials in Interior Furniture and Decoration Materials" has a certain effect on improving product quality, reducing indoor pollution, and regulating the normal order of the decoration and decoration market. However, due to the lack of refinement of the "Limited Standards", even if the furniture purchased by consumers is a qualified product, there may be indoor pollution, and it is difficult to determine the responsibility.
Use environmental labeling requirements are higher
On May 31, 2004, the guiding standard “Technical Requirements for Furniture Environmental Products†formulated by the State Environmental Protection Administration was implemented. This technology requires certain requirements for the quality of hazardous materials in the environmental labeling products of furniture and the discharge of pollutants in the production process. Only the products that meet the conditions in the standard can obtain the environmental ten-ring mark. Comments: Compared with the "Limited Quantity of Hazardous Substances in Wood Furniture for Interior Decoration Materials", "Technical Requirements for Furniture Environmental Products" not only increases the control of environmental pollution behavior in the production process, but also proposes limits on harmful substances in furniture. Higher requirements, "Limited Hazardous Substances in Wood Furniture for Interior Decoration Materials" only stipulates the formaldehyde emission and soluble heavy metal content of wood furniture, while the "Technical Requirements for Furniture Environmental Products" refers to formaldehyde in furniture environmental labeling products. There are restrictions on the content of benzene, xylene and heavy metals. Therefore, the furniture products that receive the environmental ten-ring mark are not only qualified products, but also nationally recognized environmentally friendly products.
